Terms of service
1. General provisions
1.1 These Terms of Service (the "Terms") are a binding legal document for the Parties which sets out the rights, obligations and responsibilities of the Customer and the Service Provider when the Customer orders telecommunications equipment repair services.
1.2 The Service Provider reserves the right to amend, modify or supplement the Terms and Conditions at any time, taking into account the statutory requirements. The Client will be informed of changes to the Rules via the company's website. When the Client orders the Services, the Terms and Conditions in force at the time of the order shall apply.
1.3:
1.3.1. able-bodied natural persons, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court;
1.3.2. minors aged between 14 and 18, only with the consent of their parents or guardians, unless they are self-reliant;
1.3.3. legal persons;
1.3.4. authorised representatives of all the above.
1.4 By accepting the Terms and Conditions, the Service Provider warrants that the Customer has the right to subscribe for the Services in accordance with clause 1.3.
1.5 The Contract between the Customer and the Service Provider shall be deemed to be concluded from the moment the Customer forms an order, specifies the place of provision of the Services, chooses the payment method and accepts the Service Provider's Terms and Conditions.
1.6 Each contract concluded between the Client and the Service Provider shall be stored in the Service Provider's system.
2. Protection of personal data
2.1 The Client may:
2.1.1. by registering on this website by entering the details requested in the registration;
2.1.2. without registering on this website.
2.2.When ordering services in the manner provided for in Clause 2.1, the Customer shall specify the personal data necessary for the proper execution of the order in the relevant information fields provided by the Service Provider: name, surname, address for the provision of the services, telephone number and e-mail address.
2.3 By accepting these Terms and Conditions, the Customer consents to the processing of the personal data provided in Clause 2.2 for the purposes of the provision of the Services, the analysis of the Service Provider's activities and direct marketing. The Customer has the right to withdraw his/her consent to the processing of personal data for direct marketing purposes at any time.
2.4 By consenting to the processing of his/her personal data for the purpose of the provision of the Services, the Customer also consents to the sending of information messages to the email address and telephone number provided by him/her, which are necessary for the fulfilment of his/her order for Services.
2.5 By registering on the website and ordering services, the Customer undertakes to protect and not to disclose the login data to anyone.
3. Client rights and obligations
3.1 The Customer shall be entitled to order services in accordance with the procedures set out in these Terms and Conditions and in the other information sections of the Website.
3.2.The Client shall have the right to withdraw from the service provision contract by notifying the Service Provider in writing (by e-mail) not later than within 14 working days from the date of conclusion of the contract, unless the contract cannot be withdrawn from according to the laws of the Republic of Lithuania.
3.3 The Customer may exercise the right provided for in Clause 3.2 only if the service has not yet commenced or no part of the service has been provided.
3.4 The Client undertakes to accept the services rendered and to pay the agreed price for them.
3.5 If the details provided by the Client in the registration form change, the Client must update them immediately.
3.6 The Client undertakes not to pass on his/her login data to third parties. If the Customer loses his/her login details, he/she shall immediately inform the Service Provider.
3.7 By using the services, the Client agrees to these Terms of Service and undertakes to comply with them and not to violate the legislation of the Republic of Lithuania.
4. Rights and obligations of the Service Provider
4.1 The Service Provider undertakes to provide all the conditions for the Customer to make proper use of the services provided.
4.2 If the Customer attempts to undermine the stability and security of the Service Provider's systems or breaches its obligations, the Service Provider shall have the right to restrict or suspend the Customer's access to the Services or, in exceptional cases, to cancel the Customer's registration by notifying the Customer.
4.3 The Service Provider undertakes to respect the Customer's right to privacy with respect to the personal information provided in the registration form.
4.4 The Service Provider undertakes to provide the requested services at the address specified by the Customer or remotely as agreed.
5. Ordering services, prices, payment procedures, terms
5.1 The Services are available 24 hours a day, 7 days a week.
5.2 The Agreement shall commence from the moment the Client confirms the order and the Service Provider confirms the order by sending a confirmation email to the email address specified by the Client.
5.3 The prices for the Services shall be quoted in Euro, including VAT where applicable.
5.4 The Client shall pay for the Services in one of the following ways:
5.4.1. e-Banking payment means a prepayment using the e-banking system used by the Customer. The Customer must have signed an e-banking agreement with one of the following banks: SEB, Swedbank AB, DNB Nord, Danske, Nordea. The money is transferred to the Service Provider's current account. The security of data is the responsibility of the respective bank.
5.4.2. "Bank Transfer" means a prepayment where the Customer transfers money to the Service Provider's bank account by going to the nearest bank branch or by making an online transfer.
5.5 The Client undertakes to pay for the Services promptly. Only upon receipt of payment for the Services shall the Services commence.
6. Provision of services
6.1 The Customer undertakes to specify the exact location of the Services when selecting the location of the Services at the time of booking.
6.2 The Client undertakes to accept the Services himself. If the Client is unable to accept the services himself and the services are provided at the address indicated, the Client shall have no claim against the Service Provider for providing the services to the wrong entity.
6.3 The Services shall be provided by the Service Provider or its authorised representative.
6.4 The Service Provider shall provide the Services in accordance with the terms and conditions specified by the Customer at the time of the order. These terms and conditions are provisional and may vary due to unforeseen circumstances beyond the control of the Service Provider. In such cases, the Service Provider undertakes to contact the Customer immediately to agree on the terms and conditions for the provision of services.
6.5 The Service Provider shall be exempt from liability for failure to meet the deadlines for the provision of services if the services are not provided to the Customer on time due to the fault of the Customer or due to circumstances beyond the control of the Service Provider.
6.6 The Customer must inform the Service Provider immediately if the services provided do not comply with the terms of the order.
7. Service quality, guarantees
7.1 The Service Provider undertakes to provide the Services in accordance with the quality standards set out in the relevant legislation in force in the relevant fields.
7.2 The Service Provider shall not be liable for the quality of the Services if the deficiencies are due to incorrect information provided by the Customer or other circumstances beyond the control of the Service Provider.
8. Return and exchange of services
8.1.Deficiencies in the services rendered shall be eliminated, poor quality services shall be replaced or compensated in accordance with the Order of the Minister of Economy of the Republic of Lithuania of 29 June 2001 No. 217 „On the Approval of the Rules of Return and Replacement of the Services“, unless the contract cannot be cancelled in accordance with the laws of the Republic of Lithuania. Refunds for faulty services shall be made within 14 days of the complaint being satisfied.
8.2 In order to make a complaint about the quality of the Services, the Customer may do so within 14 working days of the provision of the Services by informing the Service Provider by the means of communication specified in the contact section, indicating the name of the Service, the order number and the reasons for the complaint.
8.3 The Service Provider shall be entitled to refuse to settle a claim if the Customer has not complied with the terms and conditions set out in the provision of the Services or has not provided the required information.
8.4 In the event of incorrect or inadequate provision of the Services, the Service Provider undertakes to re-provide the Service or refund the amount paid.
9. Responsibilities of the client and service provider
9.1 The Client is fully responsible for the accuracy of the personal data provided. If the Customer fails to provide accurate personal data, the Service Provider shall not be liable for the consequences thereof and shall be entitled to claim direct damages from the Customer.
9.2 The Client is responsible for the actions performed using this service.
9.3 Once registered, the Customer shall be responsible for the transfer of his/her login data to third parties. If the Services are used by a third party who has logged in using the Customer's login credentials, the Service Provider shall treat that third party as the Customer.
9.4 The Service Provider shall be indemnified against all liability if the loss is caused by the Client's failure to comply with the Service Provider's recommendations and obligations or to read the Terms and Conditions when given the opportunity to do so.
9.5 If the Service Provider's website contains links to the websites of other companies, institutions, organisations or individuals, the Service Provider is not responsible for the information or activities contained therein, as it does not supervise, control or represent such companies or individuals.
9.6 In the event of damage, the Party at fault shall indemnify the other Party against direct damages.
10. Marketing and information
10.1 The Service Provider may, at its sole discretion, initiate various promotions on the Website.
10.2 The Service Provider shall be entitled to unilaterally change or cancel the terms of the Promotion without prior notice. Any modification or cancellation of the terms and conditions of the Promotion shall be effective only prospectively from the time of its execution.
10.3 The Service Provider shall send all notifications by the means of communication specified in the Customer's registration form.
10.4 The Client shall send all notifications and questions to the telephone numbers and email addresses indicated in the Service Provider's contacts.
10.5 The Service Provider shall not be liable if the Client does not receive the information or confirmation messages sent due to disruptions in the internet connection or email service provider networks.
11. Final provisions
11.1 These Terms of Service are made in accordance with the laws and regulations of the Republic of Lithuania.
11.2 All disputes arising out of the operation of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
